Terms of Service

These are the rules for using Cottontail AAC. Please read them before creating an account. By using the app, you agree to these terms.

1. About Cottontail

Cottontail AAC (the "app") is a mobile application published by Cottontail AAC ("we," "us," or "Cottontail") for iOS and Android. It helps non-verbal children communicate using pictograms, text-to-speech, and customizable phrase boards.

2. Eligibility

You must be at least 18 years old (or the age of majority where you live) to create an account. Cottontail is intended for use by children under the supervision of a caregiver — the caregiver is the account holder.

3. Accounts

• You are responsible for keeping your username and password confidential.
• You are responsible for everything that happens under your account, including purchases, custom content, and personalization.
• You must provide a valid email address so we can help you recover access if needed.
• One account = one child's personalized vocabulary. You may create multiple accounts for multiple children.

4. What you may do

You may:

• Use Cottontail personally for your child, family, students, or clients.
• Customize any card, folder, or phrase.
• Attach your own photos, drawings, or emoji to cards.
• Use Cottontail in a classroom or therapy setting, subject to your school or organization's own policies.

5. What you may not do

You may not:

• Reverse-engineer, decompile, or attempt to derive source code from the app.
• Bypass or attempt to bypass the Lifetime Unlock or any other security feature.
• Use the app to harass, abuse, harm, or exploit any person.
• Upload content that is illegal, hateful, sexually explicit, or that infringes another person's rights.
• Use the app to impersonate another person.
• Resell, redistribute, or commercially exploit access to the app without our written permission.

6. Purchases (Lifetime Unlock)

• The Lifetime Unlock is a one-time in-app purchase that grants access to premium features (Quick, Keyboard, Calm, Mine tabs, custom cards, and favorites) for as long as the app is offered.
• The purchase is processed by Apple or Google, whose refund and billing policies apply. We do not process card details ourselves.
• The Lifetime Unlock is tied to the app store account (Apple ID or Google account) that made the purchase, and unlocks premium on devices signed in to that app store account. Family Sharing through Apple or Google may extend access to eligible family members under Apple's and Google's rules.
• You can restore the purchase on a new device by tapping "Restore Purchases" in Settings.
• The Lifetime Unlock is not transferrable to a different app store account.

7. Refunds

All refund requests are handled by Apple or Google under their standard policies. We cannot issue refunds directly. To request a refund, use reportaproblem.apple.com for Apple purchases or your order history in Google Play.

8. Content ownership

• You retain full ownership of any custom cards, photos, folders, and text you add to your Cottontail account.
• Cottontail (the app itself, the mascot, the pre-built pictograms, the source code, and all UI) is owned by us. You may not copy or redistribute it outside your own use of the app.
• By using Cottontail you grant us a limited, non-exclusive license to store your custom content on our servers only for the purpose of syncing it to your logged-in device. We do not use your custom content for any other purpose, and we never share it with anyone.

9. Offline use and reliability

Cottontail's text-to-speech and communication features work offline. However, we do not guarantee uninterrupted service:

• Your device's operating system controls the underlying voice engine. Software updates on the device may affect voice quality.
• Server-side features (login, purchase restore, favorites sync) require an internet connection and depend on third-party services (Apple, Google, RevenueCat, cloud infrastructure).
• In an emergency, please do not rely solely on Cottontail. Call 911 (US) / your local emergency number and seek help immediately.

10. Disclaimer of warranties

The app is provided "as is" and "as available." To the maximum extent permitted by law:

• We disclaim all warranties, express or implied, including fitness for a particular purpose and non-infringement.
• We do not warrant that the app is error-free, uninterrupted, or that any particular clinical outcome will result from its use.

11. Limitation of liability

To the maximum extent permitted by law, our total liability for any claim arising out of your use of the app is limited to the amount you paid us for the app (which, for most users, is $29.99 or $0). We are not liable for indirect, consequential, incidental, or punitive damages.

Nothing in this section limits liability that cannot legally be excluded (such as gross negligence or willful misconduct).

12. Termination

• You may stop using the app at any time and delete your account from within the app (Settings → Delete Account).
• We may suspend or terminate your account if you materially violate these Terms (e.g., attempting to bypass the paywall, harassing another user, illegal use). We will do our best to notify you first unless the violation is severe.
• Termination does not entitle you to a refund of any Lifetime Unlock purchase; refund requests must go through Apple or Google as described in Section 7.

13. Changes to these Terms

We may update these Terms from time to time. If we materially change them, we will notify caregivers by email and update the "Last updated" date. Your continued use of the app after a change means you accept the new Terms.

14. Governing law

These Terms are governed by the laws of the State of Washington, United States, without regard to its conflict-of-law rules. Any dispute will be resolved in the state or federal courts located in Pierce County, Washington.

If any part of these Terms is found unenforceable, the rest remain in effect.
