Terms of Service
These are the rules for using Cottontail AAC. Please read them before creating an account. By creating an account or using the app, you agree to these Terms and to our Privacy Policy, which is incorporated into these Terms by reference.
1. About Cottontail
Cottontail AAC (the "app") is a mobile application published by Cottontail LLC ("we," "us," or "Cottontail") for iOS and Android. It helps non-verbal children communicate using pictograms, text-to-speech, and customizable phrase boards.
Cottontail is a communication aid, not a medical device. It is not intended to diagnose, treat, cure, or prevent any medical condition. It is not a substitute for speech-language therapy, medical care, or emergency communication. In an emergency, call 911 or your local emergency number.
2. Eligibility
You must be at least 18 years old (or the age of majority where you live) to create an account. Cottontail is intended for use by children under the supervision of a caregiver — the caregiver is the account holder and is responsible for the account and for supervising the child's use of the app.
3. Accounts
- You are responsible for keeping your username and password confidential.
- You are responsible for everything that happens under your account, including purchases, custom content, and personalization.
- You agree to provide accurate information and to notify us promptly of any unauthorized use of your account.
4. Rules of use
- Don't reverse-engineer, decompile, or attempt to bypass the app's paywall or purchase system.
- Don't resell, sublicense, or provide unauthorized access to the app or its content.
- Don't upload, attach, or link to illegal, hateful, or sexually explicit content, including through custom cards, photos, or the Calm Videos feature (Section 7).
- Don't use the app to harass, exploit, or endanger any person, including a minor.
- Don't use the app in any way that violates applicable law.
We may suspend or terminate an account that violates these rules (see Section 12).
5. Purchases and refunds
- Premium ($29.99) — one-time purchase, 1 profile, unlocks the full app.
- Pro ($200) — one-time purchase, up to 10 profiles, unlocks the full app for SLPs and clinics.
- School ($400) — one-time purchase, up to 25 profiles, unlocks the full app for schools and districts.
- All paid tiers are one-time purchases. There are no subscriptions and nothing auto-renews.
- Purchases are processed by Apple's App Store or Google Play. Refunds are handled by Apple or Google under their own standard policies — we are not able to issue refunds directly.
- If you get a new device, use "Restore Purchases" in Settings to unlock your paid tier again at no additional charge.
- Schools needing a purchase order should contact support@cottontailapp.com.
6. Your content and the license you grant us
You retain ownership of any custom cards, phrases, folders, notes, and photos you create or upload in the app ("Your Content"). We do not claim ownership of Your Content.
To provide the app's features — including syncing your customizations across devices, backing up your data, and displaying your content back to you — you grant Cottontail LLC a limited, non-exclusive, royalty-free license to store, host, back up, and transmit Your Content solely for the purpose of operating the app for your account. We do not use Your Content for advertising, sell it, or share it, except as described in our Privacy Policy.
Photos attached to custom cards are stored on your device; whether they are also stored on our servers depends on whether you enable cloud sync/backup, as described in the Privacy Policy.
7. Third-party and licensed content
7A. Sing-Along — licensed audio (not third-party embedded content)
Sing-Along plays a small set of children's songs that Cottontail has licensed and bundled directly into the app, along with matching picture cards. These songs are stored on the device and play offline — they are not streamed from YouTube or any other outside service.
7B. Calm Videos — embedded YouTube content
- Calm Videos plays video through YouTube's privacy-enhanced, no-cookie embedded player. A default set of calming videos is chosen and reviewed by Cottontail. The player is locked so that the only available action is playing the selected video — related videos, comments, and outbound links are blocked.
- Caregivers may replace or add their own YouTube videos in this section. Any video a caregiver adds is chosen and controlled entirely by that caregiver. Cottontail does not review, endorse, or take responsibility for caregiver-added videos, and you agree that you are solely responsible for any content you add here.
- YouTube's own Terms of Service and Privacy Policy apply whenever a video is played, regardless of who selected it.
7C. Pictograms
The pictograms built into the app were created using AI image-generation tools and curated by Cottontail. You may use them within the app as intended. You may not extract, copy, redistribute, or use these pictograms outside the app, or use them for any commercial purpose other than your own personal or professional use of Cottontail.
8. Our intellectual property
The Cottontail name, logo, app design, pictogram library, and underlying software are owned by Cottontail LLC or its licensors and are protected by copyright, trademark, and other laws. Except for the limited right to use the app as intended, nothing in these Terms transfers any intellectual property rights to you.
9. Disclaimer of warranties
The app is provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, to the fullest extent permitted by applicable law. We do not warrant any particular clinical, educational, or therapeutic result from using the app. Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you.
10. Limitation of liability
To the fullest extent permitted by law, Cottontail LLC's total liability arising out of or relating to these Terms or the app is capped at the greater of (a) the amount you paid us in the 12 months before the claim arose, or (b) $50 USD. Cottontail LLC is not liable for indirect, incidental, special, consequential, or punitive damages, including loss of data, arising from your use of the app, including content played through Calm Videos or Sing-Along. Some jurisdictions do not allow certain limitations of liability, so some of the above may not apply to you.
11. Indemnification
You agree to indemnify and hold harmless Cottontail LLC, its owners, and staff from any claims, damages, or expenses (including reasonable attorneys' fees) arising from: your violation of these Terms; content you add to the app, including videos added through Calm Videos; or your misuse of the app.
12. Termination
We may suspend or terminate your account at any time if we believe, in good faith, that you have violated these Terms. You may stop using the app and delete your account at any time through Settings → Delete Account. Sections of these Terms that by their nature should survive termination (including Sections 6, 8, 9, 10, 11, and 13) will survive.
13. Dispute resolution and arbitration
Please read this section carefully — it affects your legal rights.
- Any dispute arising out of or relating to these Terms or the app will be resolved through binding individual arbitration, rather than in court, except that either party may bring an individual claim in small claims court if it qualifies.
- Arbitration will be administered by a recognized arbitration provider (such as the American Arbitration Association) under its consumer arbitration rules, and will take place in Pierce County, Washington, unless you and Cottontail agree otherwise.
- Class action waiver: You and Cottontail agree that disputes will be brought only in an individual capacity, and not as a plaintiff or class member in any purported class, collective, or representative proceeding.
- Opt-out right: You may opt out of this arbitration agreement by emailing legal@cottontailapp.com within 30 days of first accepting these Terms, stating that you decline to be bound by the arbitration agreement. If you opt out, disputes will instead be resolved in the state or federal courts located in Pierce County, Washington.
14. Governing law
These Terms are governed by the laws of the State of Washington, USA, without regard to its conflict-of-law principles, except where superseded by applicable federal law.
15. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we will notify caregivers by email and update the "Last updated" date above. Continuing to use the app after a change takes effect means you accept the updated Terms.
16. Miscellaneous
- Entire agreement: These Terms, together with our Privacy Policy, are the entire agreement between you and Cottontail LLC regarding the app.
- Severability: If any provision of these Terms is found unenforceable, the remaining provisions will remain in full effect.
- No waiver: Our failure to enforce any provision is not a waiver of our right to do so later.
- Assignment: You may not assign these Terms. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
